Funny thing about corporations they love to bully the little guy.  According the Library of Congress'  dept. register of trademarks it is IMPOSSIBLE for Dc/ Marvel to have eminent domain over the word, " Super Hero".  That is why they approved my trademark for "Cup O Java Studio Comix A World Without SuperHeroes".  It is mine and I own it. Nuff Said?  No. According to Kinley and Kinley.  Despite the fact that my trademark is legitimate, DC/ Marvel  lawyers still intend on taking me to court.  They claim they own every variation of the word "Super Hero". 

 They've even got CBLDF scarred into believeing this myth is true.  They will not represent me because they feel that it is not a freedom of speech issue.  I disagree.  When the "big two" tells the world around that they own the word "Super Hero" and sues everyone in site based on variations of the word, that is clearly a violation against freedom of speech and word usage."  For those of you who do not know, trademarks only protect the literal element.  That means one word for a specific number of products.  It does not cover variations of any word.  In this case it is as if I decided to trademark the words "God", "Jesus" and "Satan the Devil". 

 Then turn around and charge every church, minister, religion and bible printing company for usage of that word.  I cannot do this because the words "God" , Jesus" and "Satan the Devil" are public domains and can be used by anyone just as they can use "Zeus",  "Hermes" "Hercules" or "Thor".  The word Super Hero" , "Super Heroine" and Super Villain" are also public domain, but DC and Marvel sue people and corporations so that the word cannot maintain its public domain status.  Clearly that sounds absurd, but it is in fact what DC/ Marvel are doing.  They've trademarked "Super Hero" , "Super Heroine" and "Super Villain", just to name a few for clarity.  

They've even got cases against companies for using "Thor" which is absurd, because they did not create the Norse God of thunder.  Then they've illegally licensed the word to other companies and individual who wished to use the word on any product being sold in the market.  

In short, DC/ Marvel lawyers are involved in illegal activity by licensing a word from the Webster's dictionary.  They even go so far as to claim that they invented "Super Heroes".  If that were true how could one explain Tarzan, Zorro, Flash Gordon, The Phantom, Mandrake the Magican, The Shadow, Doc Samson or the Spider?  All whom existed before Marvel (formerly known as Timely Comics) and DC came into operation.    
The reality is that they cannot, but they've gone unchecked and left to their own devices to create a Monopoly which is illegal as well.

They did the same thing to Dan Taylor with his "Super Hero Happy hour" series ages ago.... Made him change it to Hero Happy Hour.
I urged him to go rogue and fight it! But court costs can add up. I say look into other lawyers for the arts who may work for you probono.

I've always wanted to just make a new comic called NEW SUPER HEROES and then when they send me cease and desist letters Id film myself burning the letters and take the fight publicly to the Internet and let the people decide. It's like if coke and Pepsi trademarked the name "soda" - completely ridiculous...

But it shows what they are afraid of... They don't have anything NEW. They're afraid something else can come along called a super hero that would threaten their stranglehold on a medium.

I am actually looking for artists like ourselves who would be interested in challenging the trademark in question of DC/ Marvel. They Trademarked a word in the dictionary which according to trademark law is NOT legal, especially when they go so far as to advertise that the OWN the word exclusively and license it to other companies. Its downright unethical and more so illegal yet again.
I know a lawyer who is interested in taking this to court based on DC/ Marvels harassment towards small publishers and bullying them into defaulting on their trademarks.
